Using a Trademark before Registration in Israel

It is permissible to use a trademark prior to registering it in Israel.  Registering the trademark gives the applicant the right to use that mark in accordance with the Trademark Ordinance.  The applicant may use the trademark prior to its registration, but if someone else registers the trademark first, then the trademark may not be used.  Thus it is advisable to register a national trademark in Israel (or an international trademark, if relevant), although, as aforementioned, it is permissible to use a trademark prior to registering it.  We provide an article on exclusive registration of a trademark, particularly in cases where two applicants are competing for rights to use a trademark.
